United States District Court of New Mexico Finds For Plaintiff Ashley Imming In Reverse Piercing Case

The Furth Law Firm, P.A. has obtained relief in favor of their client, Plaintiff Ashley Imming, in a complex veil piercing case. On February 13, 2017, Plaintiff Ashley Imming first sued Defendant Osvaldo De La Vega, and Southwest Health in New Mexico state court, alleging inter alia that they had violated the New Mexico Human Rights Act (NMHRA) by subjecting her to sexual harassment in the form of a hostile work environment. Imming v. De LaVega, 2025 U.S. Dist. Lexis 187945 at 4 (D.N.M. Sep. 24, 2025). On February 13, 2020, the state district court entered a Final Judgment in the amount of $867,971.07, which included the damages award as well as Plaintiff’s attorney’s fees and costs. Id. at 5. After obtaining an affirmance on her trial verdict from the Court of Appeals, Plaintiff Imming pursued assets owned by Defendant De La Vega’s other companies, including Mesilla Capital Investments, LLC under an outsider reverse veil piercing theory. The District Court noted “New Mexico courts have not squarely addressed whether [outside] reverse veil piercing is permitted under New Mexico law and under what circumstances.” Imming v. De LaVega, 2025 U.S. Dist. Lexis 187945, at *27 (D.N.M. Sep. 24, 2025). Nevertheless, The Furth Law Firm was able to obtain relief for Plaintiff Ashley Imming on each of her claims in the Federal Court. The Court pierced Mesilla Capital Investment’s veil [Id. at 51], enjoined them from selling or transferring any real estate until the Judgment was satisfied [Id.], voided a $1.2 million transfer from Southwest Health to Mesilla Capital Investments under the New Mexico Voidable Transfers Act [Id. at 6-3], and found The Furth Law Firm was entitled to costs and fees in bringing the federal lawsuit pursuant to the New Mexico Human Rights Act. Id at 79.
